C\u00f3mo sigue el caso en la Justicia.<\/h2>\n\n\n\n<p>La\u00a0<strong>C\u00e1mara del Trabajo fall\u00f3 a favor del gobierno de Javier Milei<\/strong>\u00a0y revoc\u00f3 un amparo que<strong>\u00a0suspend\u00eda 82 art\u00edculos de la reforma laboral<\/strong>, que\u00a0hab\u00eda quedado en parte sin efecto por una cautelar del juez Ra\u00fal Ojeda. La decisi\u00f3n judicial fue celebrada por el propio Presidente y otros\u00a0funcionarios del Gabinete libertario.\u00a0<\/p>\n\n\n\n<p>&#8220;Modificar la resoluci\u00f3n del 7 de abril de 2026 y\u00a0<strong>otorgar efecto suspensivo al recurso de apelaci\u00f3n<\/strong>, deducido por el Estado Nacional, contra la resoluci\u00f3n que admiti\u00f3 la medida cautelar solicitada por la Confederaci\u00f3n General del Trabajo, de la Rep\u00fablica Argentina&#8221;, dice el fallo\u00a0firmado por\u00a0los jueces Mar\u00eda Dora Gonz\u00e1lez y V\u00edctor Arturo Pesino.<a href=\"https:\/\/www.eldestapeweb.com\/politica\/reforma-laboral\/golpe-a-la-reforma-laboral-nuevo-fallo-suspende-articulos-claves-2026330115419?utm_medium=internal&amp;utm_source=Notapropia&amp;utm_campaign=Nota_Propia\"><\/a><\/p>\n\n\n\n<p>La cautelar en cuesti\u00f3n hab\u00eda sido aceptada por el<strong>&nbsp;juez laboral Ra\u00fal Ojeda<\/strong>, que&nbsp;orden\u00f3 inhabilitar 82 art\u00edculos de la reforma laboral al considerar que exist\u00edan indicios serios de&nbsp;<strong>inconstitucionalidad y riesgo de da\u00f1os irreparables.<\/strong>&nbsp;El nuevo fallo de la C\u00e1mara del Trabajo pone en suspenso esta cautelar y le devuelve la vigencia a los art\u00edculos hasta que se resuelva la cuesti\u00f3n de fondo.&nbsp;<\/p>\n\n\n\n<figure class=\"wp-block-image\"><img decoding=\"async\" src=\"https:\/\/cdn.eldestapeweb.com\/eldestape\/042026\/1776962899836\/698dc843c40ba.webp?cw=800&amp;ch=488&amp;extw=jpg\" alt=\"\"\/><\/figure>\n\n\n\n<p>La CGT&nbsp;hab\u00eda planteado que la reforma&nbsp;<strong>implica&nbsp;una regresi\u00f3n en derechos laborales<\/strong>, afecta la libertad sindical y vulnera principios constitucionales y tratados internacionales incorporados a la Constituci\u00f3n.<\/p>\n\n\n\n<p>Esta decisi\u00f3n de la Justicia fue celebrada por el propio Milei y distintos funcionarios nacionales, como la ministra de Capital Humano,&nbsp;<strong>Sandra Pettovello<\/strong>.&nbsp;<strong>&#8220;La C\u00e1mara Laboral revoc\u00f3 la decisi\u00f3n del juez Ojeda y declar\u00f3 la vigencia de la Reforma Laboral impulsada por el Gobierno nacional. VLLC!&#8221;<\/strong>, escribi\u00f3 Pettovello en su cuenta de&nbsp;<em>X<\/em>.https:\/\/d-14981616052032021546.ampproject.net\/2603032146000\/frame.html<\/p>\n\n\n\n<p>Su mensaje fue compartido en redes por Milei, quien agreg\u00f3:&nbsp;<strong>&#8220;No podr\u00e1n detener el crecimiento que se viene para el Pa\u00eds. VIVA LA LIBERTAD CARAJO&#8230;!!!&#8221;<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Los art\u00edculos de la reforma laboral que vuelven a tener vigencia<\/h2>\n\n\n\n<p>Entre los puntos que hab\u00edan sido criticados por la central obrera y que vuelven a cobrar vigencia son los&nbsp;c<strong>ambios en el r\u00e9gimen de indemnizaciones, la ampliaci\u00f3n de facultades del empleador, la flexibilizaci\u00f3n de condiciones laborales y nuevas restricciones a la actividad sindical.<\/strong><\/p>\n\n\n\n<p><strong>En concreto, los art\u00edculos de la Ley 27.802 son el 1, 3, 6, 9, 10, 13, 16, 17, 18, 19, 23, 24, 25, 26, 27, 28, 30, 31, 32, 33, 34, 41, 42, 44, 43, 46, 47, 48, 50, 51, 53, 55, 56 y&nbsp;57.<\/strong><\/p>\n\n\n\n<p>El juez Ojeda que hab\u00eda avalado la cautelar asegur\u00f3&nbsp;que la CGT ten\u00eda la&nbsp;legitimaci\u00f3n para representar al conjunto de los trabajadores en este tipo de acciones colectivas y sostuvo que existe una&nbsp;<strong>&#8220;verosimilitud del derecho calificada&#8221;<\/strong>, es decir, fundamentos&nbsp;para presumir que podr\u00edan haberse vulnerado garant\u00edas constitucionales, en particular el principio de protecci\u00f3n del trabajo consagrado en el art\u00edculo 14 bis.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>La C\u00e1mara del Trabajo levant\u00f3 el efecto suspensivo de un amparo que reg\u00eda sobre m\u00e1s de 80 art\u00edculos y les devolvi\u00f3 la vigencia.
